Businesses frequently use the kind of automated calling technology that the TCPA restricts. Most people know too well the experience of getting a call from some strange number.  When you answer you often hear a pause (while their computer is connecting their system to your call).  Then, you might hear a live person or even a prerecorded message.  Debt collectors and telemarketers are some of the worst violators of these laws, but many other businesses also use this automated technology in ways that violate the TCPA.

Luckily, the TCPA law has penalties for businesses who violate its provisions.  These penalties basically create a system where private individuals are empowered to hold businesses accountable for their illegal practices.  The TCPA sets dollar penalties for calls, texts, or faxes that violate its provisions.  Depending on whether the violating call is considered negligent or intentional by the court, the fine is either $500 or $1,500 per call.  For example, if you received ten robocalls to your cell phone from a business that didn’t have your permission to call you, then you could receive as much as $15,000.

Prior Consent

The TCPA restricts robocalls to your cell phone when the business does not have your prior consent to call you.  Even if you once did business with the company or consented to their calls by opting in, you can revoke that consent at any time and all subsequent calls will be in violation of the TCPA.  If you gave prior consent you should consider sending the business a letter revoking consent to contact you, though you can just do it orally over the phone.  If you send a letter by certified mail you will have better proof in case you decide to file a lawsuit.
